Huawei netdisk has always been attaching great importance to the copyright protection. In accordance with relevant laws and regulations, Huawei netdisk provides the following procedures and steps to protect the legitimate rights of copyright owners.
In case a copyright owner (hereinafter called “you”) believes any words, pictures, software, videos or other contents infringes your copyright, please send Huawei netdisk a written Notification which must include the following:
The name, contact details and address of you and a person authorized to act on behalf of you on this issue (if any);
The name and URL of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled,
Preliminary evidences showing the above material constitutes copyright infringement, including evidences proving you are the copyright owner of the said material, such as relevant contracts, copyright registrations, etc.
A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the you, your agents, or the law; and
A statement that the information in the notification is accurate, and under penalty of perjury.
A signature of you or of a person authorized to act on behalf of you (if any);
Upon receipt of the written Notification containing the information as outlined above, Huawei netdisk shall do the following:
To remove or disable access to the material that is alleged to be infringing;
To forward the written notification to the alleged infringer ("Subscriber");
To promptly notify the Subscriber that it has removed or disabled access to the material.
In case the Subscriber believes the material provided by it dose not constitute copyright infringement, it may send a written Counter Notification to Huawei netdisk, requiring the material that was removed to be replaced or the access to the material that was disabled to be provided again. The written Counter Notification must include the following:
The name, contact details and address of the Subscriber;
The name and URL of the material that has been removed or to which access has been disabled before it was removed or access to it was disabled;
Preliminary evidences showing the above mentioned material dose not constitute copyright infringement, such as contracts showing the Subscriber has legitimate right to use the material, copyright registrations of the said material with the right owner’s name being the Subscriber, etc.
A statement under penalty of perjury that the Subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled;
A signature of the Subscriber.
Upon receipt of a Counter Notification containing the information as outlined above, Huawei netdisk shall do the following:
To promptly provide the Complaining Party with a copy of the Counter Notification;
To inform the Complaining Party that it will replace the removed material or cease disabling access to it within 7 working days from receipt of the Counter Notification;
To replace the removed material or cease disabling access to the material within 14 business days following receipt of the Counter Notification,
